Welcome to flexigas.nooaenergies.comm. FlexiGas ("Flexigas", "we", "us", or "our") provides a platform for cooking gas delivery services (the "Services"), accessible at flexigas.nooaenergies.comm and any other websites through which Flexigas makes the Services available (the "Site").

The Site and Services are offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the "Terms"). Your use of the Site and Services constitutes your agreement to all such Terms. We reserve the right to update or modify these Terms at any time without prior notice, and your continued use of the Site following any changes will constitute your acceptance of such changes.

Your use of the Site and Services are subject to Flexigas's Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices. Flexigas does not knowingly collect, either online or offline, personal information from persons under the age of 13.

The Site and Services are intended solely for persons who are 18 or older. Any access to or use of the Site or Services by anyone under 18 is expressly prohibited. By accessing or using the Site or Services you represent and warrant that you are 18 or older.

As a condition of your use of the Service, you agree to (a) provide Flexigas with true, accurate, current and complete information as prompted by the Flexigas registration forms, and (b) update and maintain the truthfulness, accuracy and completeness of such information.

If you use the Site or Services, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account or password. You may not assign or otherwise transfer your account to any other person or entity.

You acknowledge that Flexigas is not responsible for third-party access to your account that results from theft or misappropriation of your account. Flexigas and its associates reserve the right to refuse or cancel service, terminate accounts, or remove or edit content in our sole discretion.

The Site and Services contain links to other websites ("Linked Sites"). The Linked Sites are not under the control of Flexigas and Flexigas assumes no responsibility for their content, privacy policies, or practices. By using the Site or Services, you expressly relieve Flexigas from any and all liability arising from your use of any third-party website.

Certain services made available via the Site are delivered by third-party sites and organizations. By using any product or service originating from the Site, you acknowledge and consent that Flexigas may share information with any third party with whom Flexigas has a contractual relationship to provide the requested product or service.

You are granted a non-exclusive, non-transferable, revocable license to access and use the Site and Services strictly in accordance with these terms. All content included as part of the Site and Services — such as text, graphics, logos, and images — is the property of Flexigas, its suppliers or third parties and is protected by applicable intellectual property laws.

In your use of the Site and Services, you may not:

• Modify, publish, transmit, reverse engineer, or exploit any content found on the Site in whole or in part
• Use web crawlers, bots, worms, or other automated tools to access the Site
• Use the Site in any manner that could damage, disable, overburden, or impair the Site
• Collect personally identifiable information of other users or visitors
• Harvest information about users for the purpose of sending unsolicited communications
• Post or transmit any viruses, Trojans, or other harmful files or programs to the Site

Flexigas will fully cooperate with any law enforcement authorities or court order directing Flexigas to disclose the identity of anyone violating these Terms.

Visiting or using the Site or Services or sending emails to Flexigas constitutes electronic communications. You consent to receiving electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

All notices to Flexigas will be provided by sending an email to info@flexigas.nooaenergies.comm. Such notices will be deemed delivered upon verification of delivery or two (2) business days after being sent.

The Site may contain communication facilities such as blogs, chat areas, forums, and communities ("Communication Services"). You agree to use the Communication Services only to post, send and receive messages and material that are proper and related to the particular Communication Service.

When using a Communication Service, you will not:

• Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights of others
• Publish, post, or distribute any inappropriate, profane, defamatory, obscene, or unlawful content
• Upload files that contain viruses, corrupted files, or any other harmful software or programs
• Advertise or offer to sell or buy any goods or services unless specifically allowed by the Communication Service
• Harvest or collect information about others, including email addresses, without their consent
• Violate any applicable laws or regulations

Flexigas reserves the right to review materials posted to a Communication Service and to remove any materials in its sole discretion. Flexigas reserves the right to terminate your access to any Communication Services at any time without notice.

Flexigas does not endorse any of the services about which information is provided via the Site or Services. You are responsible for determining the identity and suitability of others whom you contact via the Site or Services. We will not be responsible for any damage or harm resulting from your interactions with any third parties.

The Site and Services are controlled, operated and administered by Flexigas from our offices within Uganda. If you access the Site or Services from a location outside Uganda, you are responsible for compliance with all local laws. You agree that you will not use the Flexigas content in any country or manner prohibited by any applicable laws, restrictions or regulations.

You agree to indemnify, defend and hold harmless Flexigas, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorneys' fees) relating to or arising out of:

• Your use of or inability to use the Site or Services
• Any user postings made by you
• Your violation of these Terms
• Your violation of any rights of a third party
• Your violation of any applicable laws, rules or regulations

YOU EXPRESSLY UNDERSTAND AND AGREE THAT FLEXIGAS WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES RESULTING FROM: (A) THE USE OR INABILITY TO USE THE SERVICE; (B) THE COST OF GOODS/SERVICES OBTAINED AS A RESULT OF USING THE SERVICE; (C) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR INFORMATION; OR (D) ANY OTHER MATTER RELATING TO THE SERVICE.

Flexigas reserves the right, in its sole discretion, to terminate your access to the Site and Services and the related services or any portion thereof at any time, without notice.

To the maximum extent permitted by law, this agreement is governed by the laws of Uganda. Use of the Site and Services is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms.

Except for claims for injunctive or equitable relief or claims regarding intellectual property rights, any dispute arising under these Terms shall be finally settled in accordance with the Comprehensive Arbitration Rules of the Judicial Arbitration and Mediation Service, Inc. ("JAMS") by a single arbitrator appointed in accordance with such Rules. The prevailing party in any action or proceeding to enforce these Terms shall be entitled to costs and attorneys' fees.
